1) Who we are & acceptance of terms

These Terms & Conditions (“Terms”) govern your access to and use of the websites, mobile experiences, ordering tools, and in-store services operated by [Company Legal Name] dba Yerr Bodega (“Yerr Bodega,” “we,” “us,” or “our”), including any connected services for The Treasury speakeasy. By visiting our site, creating an account, placing an order, or using our services, you agree to these Terms and to our [Privacy Policy].

2) Changes to these Terms

We may update these Terms at any time. Changes are effective when posted to this page with the “Last updated” date. Your continued use after changes means you accept the revised Terms.

3) Eligibility

You must be at least 13 to browse and at least 18 to create an account or place orders. Age-restricted items (if any) require a valid government ID at pickup/delivery and can be refused if ID is not provided.

4) Accounts & security

You are responsible for keeping your login credentials confidential and for activity on your account. Provide accurate information and update it as needed. We may suspend or terminate accounts that violate these Terms.

5) Menu, nutrition & allergens

Food is prepared in a shared kitchen. We cannot guarantee the absence of allergens. Please inform us of allergies; we’ll take reasonable precautions, but you assume all risk in consuming our food. Nutrition information (if shown) is estimated and for convenience only.

Menu items, prices, and availability can change without notice. Photos are for illustration.

6) Ordering, pricing & payment

• Ordering channels: counter, online ordering, and (where available) building delivery or curbside. Third-party delivery platforms are subject to their own terms and fees.

• Pricing: displayed prices are in USD and exclude taxes/fees unless noted. We reserve the right to correct pricing or availability errors; if an order cannot be fulfilled, we’ll cancel and refund the affected items.

• Payment: we accept the tender types shown at checkout (e.g., major cards, contactless). By submitting a payment method, you represent you are authorized to use it and authorize us (and our payment processor) to charge the order total, including taxes/fees/gratuities.

7) Pickup & delivery

• Pickup windows are estimates; delays can occur.

• Delivery: once an order is handed to you, your building/concierge, a parcel locker, or a third-party courier, risk of loss passes to you. We are not responsible for loss/theft after handoff.

• No-shows: orders not picked up within [45] minutes may be discarded for food safety; charges remain due.

• Address issues: if the address/instructions are inaccurate or unreachable, your order may be canceled without refund.

8) Cancellations, refunds & make-goods

For safety, food sales are final once prepared or handed off. If something isn’t right, contact us within 24 hours at [support email/phone] with your order number and a brief description/photo. At our discretion we may offer a replacement, credit, or refund for verified issues. We do not guarantee outcomes or availability of specific remedies.

9) Catering & events

Catering may require a [50%] deposit. Final counts are due [72 hours] before the event. Cancellations within [48 hours] may forfeit deposits and product costs already incurred. Venue policies for The Treasury (21+ where applicable) apply to any connected experiences.

10) Gift cards & credits

Gift cards and digital credits may be used only at Yerr Bodega (and, if stated, The Treasury). They are not reloadable, not redeemable for cash (except where required by law), and cannot be replaced if lost or stolen. Credits from promotions or make-goods may include expirations or exclusions (shown at issuance).

11) Promotions, discounts & loyalty

Promos (e.g., percentage off, BOGO, free item) are limited-time and may exclude certain items, fees, or third-party platforms. One offer per order unless stated; no cash value. We may modify or end promotions at any time. Our loyalty program (if offered) is governed by its separate terms, which are incorporated by reference.

12) Sweepstakes & contests

From time to time we run sweepstakes or contests. Official Rules posted for each promotion control and supplement these Terms.

13) User content & reviews

If you submit reviews, photos, or other content, you grant Yerr Bodega a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content for marketing or operational purposes. You represent you own or control the rights and that your content: (i) is truthful and lawful, (ii) contains no third-party IP you don’t have rights to, and (iii) does not violate these Terms.

14) Acceptable use

You agree not to: (a) use the site for unlawful purposes; (b) attempt to access accounts or systems without authorization; (c) interfere with security or site operations; (d) use robots/scrapers without our written consent; or (e) misrepresent your identity or affiliation.

15) Intellectual property

All content on our site—including logos (e.g., Yerr Bodega, the Bodega Cat mascot), designs, text, graphics, photos, videos, and software—is owned by or licensed to Yerr Bodega and protected by IP laws. You may not use our marks or content without written permission, except for personal, non-commercial site use.

16) Third-party links & services

Our site may link to third-party websites or services (e.g., delivery platforms, payment processors). We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and governed by their terms.

17) Mobile messages & emails

By providing your phone number or email, you consent to receive transactional messages regarding your orders and account. Marketing texts/emails are optional; you can opt out at any time (e.g., reply STOP to SMS, or use unsubscribe links in emails). Message & data rates may apply. Consent is not a condition of purchase.

19) Disclaimers

OUR SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 20) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YERR BODEGA, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO YERR BODEGA FOR THE ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; some of the above may not apply to you.

21) Indemnification

You agree to defend, indemnify, and hold harmless Yerr Bodega and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the services, your content, or your violation of these Terms or applicable law.

22) Dispute resolution; arbitration; class-action waiver (U.S.)

PLEASE READ THIS CAREFULLY. You and Yerr Bodega agree to resolve any disputes arising out of or relating to these Terms or our services through binding individual arbitration before JAMS/AAA (administrator to be selected by us), under its applicable rules, rather than in court, except you may bring qualifying claims in small claims court. Class actions and class arbitrations are not permitted. YOU WAIVE THE RIGHT TO A JURY TRIAL.

Opt-out: You may opt out of this arbitration agreement by emailing legal@yerrbodega.com within 30 days of your first use of the services with your name, phone, and a statement that you opt out. This Section survives termination.

23) Governing law & venue

These Terms are governed by the laws of the State of Nevada without regard to conflict-of-laws rules. Subject to the arbitration clause above, the exclusive venue for any permitted court action is the state and federal courts located in Clark County, Nevada.

24) Termination

We may suspend or terminate access to the services at any time for any reason, including violation of these Terms. You may stop using the services at any time. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, arbitration) will survive termination.

25) Miscellaneous

• Entire agreement. These Terms, plus any posted policies (e.g., Privacy Policy, Official Rules), are the entire agreement between you and us regarding the services.

• Severability. If any provision is found unenforceable, the remainder remains in effect.

• Assignment. You may not assign these Terms. We may assign them in whole or part.

• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

• Force majeure. We aren’t liable for delays or failures caused by events beyond our reasonable control.
